I have voluntarily chosen to participate in fitness activities, including but not limited to the use of exercise
equipment, classes, and facilities provided by Southern Muscle Factory Gym and Fitness Center (hereinafter referred to as “the Gym”).
In consideration of being permitted to use the Gym’s facilities and equipment, I agree to the following:

 

I understand and acknowledge that the use of the Gym’s facilities and equipment involves inherent risks, including but not
limited to the risk of bodily injury, property damage, or even death.

 

I voluntarily assume all risks associated with participating in gym fitness activities. I hereby release, waive,
discharge, and covenant not to sue the Gym, its owners, employees, agents, representatives, successors, and assigns (collectively
referred to as “the Released Parties”), from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of
or related to any loss, damage, or injury, including but not limited to personal injury, property damage, or wrongful death, that may be
sustained by me or by any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while
using the Gym’s facilities and equipment, or participating in fitness activities.

 

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages,
losses, costs, expenses, or fees (including reasonable attorneys fees) arising out of or related to my use of the Gym’s facilities,
equipment, or participation in fitness activities.

 

I hereby represent that I am in good health and have no medical condition that would prevent me from safely participating in
fitness activities at the Gym. I agree to consult with a physician before beginning any exercise program if I have any concerns about my
health or fitness level.

 

I acknowledge that I have agreed to the waiver and release by paying the membership fee.

 

I agree to be solely responsible for the safety and well-being of guests and myself. I understand that the Gym does not provide
supervision, instruction, or assistance for the use of the facilities and equipment.

 

I agree to comply with all rules imposed by the Gym regarding the use of the facilities and equipment.

 

I agree to conduct myself in a controlled and reasonable manner at all times and to refrain from using any equipment in a
manner inconsistent with its intended design and purpose.

 

I understand and agree that the Gym is not responsible for property that is lost, stolen, or damaged while in, on, or about the
premises.

 

I understand and agree that my membership will be terminated 30 days after the Gym receives my written
cancellation request. I acknowledge that any fees incurred during this 30-day period will be my responsibility.

 

I understand and agree to a $30 maintenance fee for all active members, charged twice a year on November 15 and May 15.

 

I understand the fee will be prorated based on my start date if I join the Gym after these dates. I understand that this fee does not apply
to individuals purchasing day passes.

 

I have read this Waiver and Release of Liability form carefully and fully understand its contents. The laws of the state of Alabama govern the waiver.

 

I voluntarily agree to its terms and conditions by becoming a member of the Gym. If any portion of the
the waiver is found to be invalid by a court, the remaining portions of the waiver shall remain in effect.

 

I understand and agree that the Gym is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

 

I have read this Waiver and Release of Liability form carefully and fully understand its contents. The waiver is governed by the laws of the state of Alabama. I voluntarily agree to its terms and conditions by becoming a member of the Gym. If any portion of the waiver is found to be invalid by a court, the remaining portions of the waiver shall remain in effect.
